Roundup Herbicide Litigation
General educational information — not legal advice.
What Is Roundup?
Roundup is a widely used herbicide manufactured by Bayer (formerly Monsanto). Its active ingredient, glyphosate, is one of the most commonly used herbicides in the world, applied in agriculture, landscaping, and residential settings. Roundup has been used extensively on crops genetically engineered to be glyphosate-resistant, as well as on lawns, gardens, and public spaces.
The Alleged Link to Non-Hodgkin Lymphoma
The primary health concern in Roundup litigation is an alleged link between glyphosate exposure and non-Hodgkin lymphoma (NHL), a cancer of the lymphatic system. The International Agency for Research on Cancer (IARC), a branch of the World Health Organization, classified glyphosate as "probably carcinogenic to humans" in 2015. This classification has been central to litigation against Bayer/Monsanto.
Bayer Litigation and Settlements
Bayer has faced tens of thousands of lawsuits in the United States related to Roundup. In 2020, Bayer announced a settlement of approximately $10 billion to resolve a large portion of existing cases. However, litigation has continued, and Bayer has faced ongoing legal challenges regarding its liability for future Roundup-related claims.
Regulatory Positions
Regulatory agencies have reached different conclusions about glyphosate safety. The U.S. Environmental Protection Agency (EPA) has maintained that glyphosate is not likely to be carcinogenic to humans when used as directed. However, the IARC classification and the outcomes of jury trials have kept the controversy alive. The scientific debate over glyphosate safety continues.
Who Has Been Exposed?
Roundup exposure has occurred across a wide range of settings. Agricultural workers, landscapers, groundskeepers, and others who used or were regularly exposed to Roundup in occupational settings have been among the primary plaintiffs in litigation. Residential users who applied Roundup in their gardens or yards have also brought claims.
What Is Non-Hodgkin Lymphoma?
Non-Hodgkin lymphoma is a group of blood cancers that originate in the lymphatic system. Symptoms can include swollen lymph nodes, fatigue, fever, night sweats, and unexplained weight loss. NHL encompasses many different subtypes with varying prognoses and treatment approaches. It is one of the more common cancers in the United States.
Failure to Warn Allegations
A central allegation in Roundup litigation is that Monsanto/Bayer failed to adequately warn users about the potential cancer risk associated with glyphosate exposure. Plaintiffs have pointed to internal company documents suggesting that the company was aware of concerns about glyphosate and cancer and took steps to influence scientific research and regulatory assessments.
Current Litigation Status
Roundup litigation remains active. While Bayer has settled a large number of cases, new cases continue to be filed. The company has sought to establish a framework for resolving future claims, but legal challenges to that framework have continued. The litigation is expected to continue for years.
