Paraquat and Parkinson Disease Litigation
General educational information — not legal advice.
What Is Paraquat?
Paraquat dichloride is a highly toxic herbicide used primarily in commercial agriculture to control weeds and grasses. It is one of the most widely used herbicides in the world, though its use is restricted or banned in many countries due to its extreme toxicity. In the United States, paraquat is a restricted-use pesticide, meaning it can only be purchased and applied by licensed applicators.
The Alleged Link to Parkinson Disease
Paraquat litigation centres on allegations that exposure to paraquat increases the risk of developing Parkinson disease, a progressive neurological disorder. Scientific research has suggested a biological mechanism by which paraquat may cause oxidative stress in dopamine-producing neurons in the brain, which is consistent with the neurodegeneration seen in Parkinson disease. Multiple epidemiological studies have found associations between paraquat exposure and Parkinson disease risk.
Who Manufactures Paraquat?
Paraquat is manufactured and sold under various brand names, including Gramoxone, by Syngenta and other companies. Lawsuits have been filed against Syngenta and Chevron Phillips Chemical Company, alleging that these companies knew or should have known about the link between paraquat and Parkinson disease and failed to adequately warn users.
Who Has Been Exposed?
Paraquat exposure has occurred primarily in agricultural settings. Farmers, farm workers, agricultural labourers, and others who mixed, loaded, or applied paraquat as part of their work are among those who may have been exposed. Exposure can occur through inhalation, skin contact, or ingestion. Even small amounts of paraquat can be highly toxic.
What Is Parkinson Disease?
Parkinson disease is a progressive neurological disorder that affects movement. Symptoms typically develop gradually and include tremors, stiffness, slowness of movement, and balance problems. As the disease progresses, it can significantly impair daily functioning. There is currently no cure for Parkinson disease, though medications and other treatments can help manage symptoms.
Multidistrict Litigation
Paraquat Parkinson disease cases have been consolidated into a federal multidistrict litigation (MDL) in the Southern District of Illinois. The MDL allows for coordinated pretrial proceedings across thousands of individual cases. Bellwether trials are expected to provide important guidance on how juries evaluate the scientific evidence and the companies liability.
Scientific Evidence
The scientific evidence linking paraquat to Parkinson disease includes laboratory studies, animal studies, and epidemiological research. The National Institutes of Health (NIH) has funded research examining the relationship between pesticide exposure and Parkinson disease. While the scientific community continues to study this relationship, the existing evidence has been sufficient to support large-scale litigation.
Current Litigation Status
Paraquat litigation is one of the most significant mass tort proceedings currently active in the United States. Thousands of cases are pending in the MDL. The litigation is at a critical stage, with expert discovery and bellwether trial preparation underway. Outcomes remain uncertain, and the litigation is expected to continue for several years.
